Who we are

GapCheck is a product of Codewave Studio ("we", "us", or "our"). By accessing or using GapCheck at trygapcheck.com (the "Service"), you agree to be bound by these Terms of Service.

Description of service

GapCheck is an AI-based tool that analyzes text and web content to identify potential gaps between the author's intended message and how a target audience may perceive it. Analysis results are generated by third-party artificial intelligence models and are provided for informational purposes only.

No guarantee of accuracy

AI-generated analysis is inherently probabilistic and may be incorrect, incomplete, or not applicable to your specific situation. GapCheck results should be used as a starting point for reflection, not as definitive professional advice.

GapCheck makes no warranties, express or implied, about the accuracy, reliability, or fitness for a particular purpose of any analysis output. You are solely responsible for any decisions made based on GapCheck results.

Gap scores and range classifications are generated by AI and are illustrative only. They are not based on validated research or empirical methodology and should not be used as the sole basis for any business, professional, or creative decision.

Acceptable use

You agree not to:

  • Submit content that is illegal, defamatory, harassing, or harmful
  • Submit content that infringes the intellectual property rights of others
  • Submit personal information about third parties without their consent
  • Attempt to reverse-engineer, scrape, or abuse the service
  • Use automated tools to submit bulk requests without prior written consent
  • Use automated tools, fake identities, or technical manipulation to obtain more free analyses than permitted, or to access features reserved for paid users

We reserve the right to suspend or terminate access for violations without notice.

Intellectual property

You retain ownership of any content you submit. By submitting content, you grant GapCheck a limited, non-exclusive license to process that content for the purpose of delivering the Service, including through third-party AI providers engaged to generate analysis results.

All software, design, branding, and other elements of GapCheck are the property of GapCheck and may not be copied, modified, or redistributed without written permission.

Payments and refunds

All purchases are final. Subscriptions may be cancelled at any time and will not renew after the current billing period ends. Credit packs do not expire. We do not offer refunds except where required by applicable law.

All payments are processed by Stripe. For billing issues, contact hello@trygapcheck.com.

Limitation of liability

To the maximum extent permitted by applicable law, GapCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of GapCheck.

In no event shall GapCheck's total liability to you exceed the greater of (a) the total fees paid by you to GapCheck in the twelve months preceding the claim, or (b) CAD $50.

Indemnification

You agree to indemnify and hold harmless GapCheck and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your submitted content, or your violation of these Terms.

Service modifications and availability

GapCheck reserves the right to modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable to you or any third party for any such changes. We do not guarantee uninterrupted or error-free availability of the Service.

Eligibility

You must be at least 16 years of age to use GapCheck. By using the Service, you represent that you meet this requirement. If you are under 16, you may not use the Service.

Dispute resolution

Before initiating any formal legal proceeding, you agree to contact us at hello@trygapcheck.com and give us 30 days to attempt to resolve the dispute informally. Most issues can be resolved this way.

If informal resolution fails, these Terms are governed by and construed in accordance with the federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Canada.

Changes to these terms

We may update these Terms from time to time. Material changes will be reflected in an updated "Last updated" date at the top of this page. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
